PUBLIC HEARING

ZBA2018-1Application for Special Exception for Archery lesson, leagues and events at 148 River Road (Map 15 Lot 27 Zone R80) Owner: Kosowicz Family Living Trust Applicant: William Hall (Received February 8, 2018 Public Hearing March 8, 2018 Decision within 65 days after close of P.H.)

William Hall was present to speak about his application. He stated that he has had a business in Town and was moving to 148 River Road.

Richard Maloney asked about the number of employee and if they had a parking plan.

W. Hall said that he would be the only employee and will only be doing instructional training, no open range time and no retail.

He said that all classes are held in the evening when the other businesses in the complex are closed. The class size is limited to 10 students.

R. Maloney said that a letter had been submitted by Thomas Buccino and abutting property owner and it will be added to the application.

The Board Members, owner and applicant reviewed the letter and held a discussion on the parking.

R. Maloney motion to reconvene with the applicant and the discussion on parking after the Owner had completed a parking plan. J. Rup seconded the motion.

ZBA2018-2 Application for approval of gasoline station location for the sale of fuel at 350 Ruby Road (Map 42 Lot 48 Zone DI) Owner/Applicant: FedEx Ground Package Systems (Received February 8, 2018 Public Hearing March 8, 2018 Decision within 65 days after clos of P. H.)

Dory Famiglietti was present to representing the applicant. Bill Monroe from FedEx was also present to answer question.

D. Famigliette said the application is for approval of location which is need per CGS sec-14.321, which says you need approval for the local authority.

D. Famigliette said the sale of fuel is going on at this time and has since 2006. In 2006 FedEx applied for and received from the Department of Revenue Services a Special Fuel Distribution License. Now the Department of Consumer Protection has told FedEx that they view this as retail sale and they need to get a Dealer’s License.

We are in the process of getting the license, we first needed to apply to the Town for a Regulation Change for fuel sales accessory to a warehouse packaging facility sale are limited to those directly engaged in the warehouse packaging operations and not to the general public which we received last month. The next step is getting approval for gasoline station location for the sale of fuel from Zoning Board of Appeals.

D. Famigliette reviewed the map of the site and the new location of the new fuel island with the Board Members.

R. Maloney asked if anyone wanted to speak either for or against the application.

Jeff Uziemblo from Wilderness Way spoke of his concerns about lighting and noise pollution.

Ralph Tulis spoke in favor of the application.

M. Masinda motion to close the P. H. on ZBA2018-2 W. Bland seconded the motion. All voted in favor.

The Board Members returned to the previous application ZBA2018-1. The owner submitted a parking plan showing the locations and number of parking spaces.

J. Rup motion to approve ZBA2018-1 Special Exception for Archery Lessons, Leagues and Events. W. Bland seconded the motion. Members felt that the parking requirement had been met.  All voted in favor.

W. Bland motion to approve ZBA2018-2 for the approval of gasoline station location for the sale of fuel as it applies to CGS sec-14.321. J. Rup seconded the motion. All voted in favor.

R. Maloney motion to approve the minutes of September 14, 2017. M. Masinda seconded the motion. All voted in favor.
