Public Hearing

W. Parsell called the Public Hearing to order at 7:30.

PZC2018-6 Application to amend Special Permit and approved site plan to allow for sale of fuel to it’s contractor at 350 Ruby Road (Map 42 Lot 48-01 Zone DI) Owner/Applicant: FedEx Ground Package System, Inc. (Received March 20, 2018 Public Hearing April 3,2018 Decision within 65 days after close of P.H.)

Attorney Dorian Famiglietti was present for the applicant.  She said they were previously before the Commission to approve amending the zoning regulations for the sale of fuel to contractors.  She said they then went to ZBA for approval of the location and they are now back to amend the Special Permit and site plan. 

Atty. Famiglietti presented plans showing the new fuel Islands.  There will be 3 new tanks with a 60,000 gallon capacity.  She said there will be no signage for the tanks or sale to the general public and added that the tanks will be behind security gates.  Atty. Famiglietti said, after this is approved, they will submit the application to the state for the sale of gasoline and they hope to be up and running by the end of May. 

A discussion was held on the pumps safety features.  W. Parsell asked if they had an updated spill prevention plan. Atty. Famiglietti said she will follow up on it to make sure it is changed to include the new pumps and send the update to S. Yorgensen.

There were no questions from the Public.

W. Parsell motioned to close the Public Hearing.  D. Roberts seconded the motion.  All in favor.  Motion carried.

Regular Meeting

PZC2018-7 Application to amend Special Permit to install parking lot lighting at 511 River Road (Map 39 Lot 6 Zone R80) Owner/Applicant: Town of Willington (Received April 3, 2018 Public Hearing or decision by June 5, 2018)

Joe Colangelo and Maureen Parsell were present and submitted plans.  J. Colangelo said there is lighting issue which is a safety issue on River Road.  He said they would like to install six 20’ poles to light the drive through the park.  The lights will be dark skies and full cut-off. He said they will go on at dusk and not stay on much later than 9:00 at night.  

R. Belair asked about lighting the signs because people are driving the wrong way and J. Colangelo said maybe at a later date.  He added that they would like to start as soon as possible.  The Commission agreed a Public Hearing was not needed.

PZC2018-8 Request for waiver of Public Hearing for retail sales, storage, office and showroom space at 331 River Road (Map 30 Lot 16 Zone DC) Owner/Applicant:CSB Properties LLC (Received April 3, 2018)

Dave Stuart of CSB properties was present. He said DTD Group, a retailer of motorcycle parts and accessories, is looking to occupy the space previously used for retail sales.  He said there will be no change in the floor plan and the signage will remain the same size.  S. Yorgensen said he will have to submit a sign application. 

Discussion was held on parking and Mr. Stuart said there is parking in the back, on the side and 2 spaces in front.  R. Belair asked how many customers at a time and the applicant said 2 to 3.

S. Yorgensen said this is a request for waiver of a public hearing to fall under a previous special permit approved for retail sales.

W. Parsell motioned to waive the Public Hearing.  D. Roberts seconded the motion.  All in favor.  Motion carried.

A. Marco motioned to approve PZC2018-6 as submitted with the following; all previously approved Special Permit conditions shall apply and an updated Spill Prevention Plan to be submitted.  D. Roberts seconded the motion.  All in favor.  Motion carried.

S. Yorgensen said she has reviewed the application and it is complete.

W. Parsell motioned to approve PZC2018-7.  R. Belair seconded the motion.  All in favor.  Motion carried.

PZC2018-8 Request for waiver of Public Hearing for retail sales, storage, office and showroom space at 331 River Road (Map 30 Lot 16 Zone DC) Owner/Applicant:CSB Properties LLC (Received April 3, 2018)

Discussion was held on PZC2018-8. 

A. Marco motioned to add an item to agenda for review of application submitted with PZC2018-8.  W. Parsell seconded the motion.  All in favor.  Motion carried.

D. Roberts motioned to approve the application to fall under a previously issued special permit, for CSB properties pursuant to section 13.02 of the Zoning regulations, “the Board may waive the requirement to a special permit/exception where it finds that one special permit or exception use is being substituted for another similar use on the same lot that was previously granted”.  The substituted use will not entail an exterior change, additional parking or loading than previous uses.  The new use will have no impact on the site, the neighborhood or town which is different from original impact. A. Marco seconded the motion.  All in favor.  Motion carried.

D. Roberts motioned to approve the minutes of January 16, 2018.  J. Lucia seconded the motion.  All in favor.  Motion carried.

Staff Report and Discussion

S. Yorgensen said Randy from DTD Group is interested in buying the building at 331 River Road.  She said they eventually want to have a motorcycle dealership at this location; she added that they would need a Dealer Repair License.  S. Yorgensen recommended the applicant come before the Commission with the entire application but the applicant said they would come back with this portion at a later date.

A. Marco asked that S. Yorgensen refer to the regulations and inform the applicant of what would be required for dealership approval.  S. Yorgensen said she would include it on the letterhead for this approval.
