Regular Meeting

Inland Wetlands Commission Forest Practice Regulations

T. Gutowski said she would also like to review the proposed regulations and look at the application and fee structure.  She wondered if she should also meet with PZC again.  

The Commission reviewed State Statute Section 23-65K, Municipal Regulation of Forest Practices.  

Discussion was held on the requirements of reporting to DEEP.  T. Gutowski would like to check on a DEEP Forestry Reporting form and if so, add it to the regulations. She said they could say “pursuant to the statute, submitting the form required”.    She would also like to verify that the state does not have forestry regulations in place.  

The Commission reviewed the definitions in the Forest Practice Regulations.  S. Yorgensen will confirm that the statutes included in the definitions are accurate.  A discussion was held on “Cover strip” and T. Gutowski would like to revisit this at a later date.  She said the Commission will also have to create an application form.

T. Gutowski suggested getting an intern to pull all the logging applications and compile a list of the board feet applied for.

Discussion was held on “Operator” and S. Yorgensen said she will get the definition for Forest Practitioner, Operator, etc. T. Gutowski said she would like to check the regulations on vernal pools.  

In section 2, DEP has to be changed to DEEP.  

The Commission reviewed Section 3, Cover strips, and would like the following changes:

Section a. (ii), change to “from the edge of the vernal pool”.

Section d., remove the second sentence.  

Section e., remove “ford or other”

The Commission reviewed Section 3.4, Wetland and Watercourses, and in Section i., T. Gutowski would like to remove part of the language as it does not apply.

T. Gutowski said she would like to check aquifer protection regulations and possibly modify the language for aquifers.

Discussion was held on haul roads, skid roads and tree marking.  A discussion was held on application requirements.

T. Gutowski would like to revisit Emergency Forest Practices and look at the wording of catastrophic event.  

The Commission reviewed Section 6, Application for a Permit to Harvest Commercial Forest Products.  T. Gutowski said their wetland regulations are a lot more process oriented and S. Yorgensen said keep in mind sometimes less is more.
